2009 Bushfires Litigation - update #6
Kilmore East trial - CFA has now completed its first round of evidence, which ran from 17 October to 31 October. During that time, the court primarily heard from members who were located on the fireground and in aircraft on Black Saturday, as well as witnesses providing information about CFA systems.
We are now preparing for our next round of evidence, scheduled to take place from 28 January to 28 February 2014. In the meantime, the court will be hearing expert evidence in relation to the electricity case involving the plaintiff and SPI Electricity. At this stage, the final submissions of the parties are scheduled for April 2014, after which the trial will conclude and the judge will make his final decision.
Many CFA members and their families have generously given their time to assist in CFA’s defence and to support those giving evidence. This contribution has been extremely important in ensuring the judge has an accurate understanding of the events of the day, the excellent work carried out by our members in the horrendous conditions and of our systems; all essential to CFA’s defence in this case.
Thank you to each and every member who has helped and continues to help CFA. We appreciate your time, dedication and contribution.
Settlement of Harkaway civil action - As I reported in my previous update this matter has been settled with no liability attributed to CFA.
Thank you to all who assisted with CFA’s defence of this action.
Murrindindi class action - The tentative trial date for this matter still remains at June 2014. To assist in the CFA defence, our Bushfires Litigation Team has commenced arranging interviews for members with our legal team, starting from mid-November.
Members can find more information regarding litigation arising out the 2009 bushfires on the Intranet or Brigades Online by following these links after logging in: About CFA → 2009 Fires – Ongoing Legal Actions.
Once again, I thank everybody who has assisted and those who continue to assist CFA in defending these proceedings. I will continue to keep you informed.
